After first year and if 19+, standard NMW applies: £12.21 (21+) until 31 March 2026, then £12.71 from 1 April 2026. Ages 18–20: £10.00 until 31 March 2026, then £10.85 from 1 April 2026.

🎓 Training & Development

Legal Requirement: From 1 August 2025, the off-the-job training requirement is set as a minimum number of hours specific to each apprenticeship standard (minimum 187 hours absolute floor). This replaces the previous flat 20% rule. Time must be delivered within normal working hours. It includes: formal learning, mentoring, practical training, shadowing, industry visits. It does NOT include English/Maths unless part of the apprenticeship standard.

📊 Support & Progress Reviews

Legal Requirement: Regular progress reviews must be conducted with the apprentice, employer, and training provider to assess development, set goals, and ensure the apprentice is on track to complete successfully.

UK Statutory Minimum: 28 days (5.6 weeks) paid holiday per year including bank holidays. Apprentices have the same entitlement as other employees.

Important: During the first 6 weeks, either party can terminate with 1 week's notice. After 6 weeks, standard employment law applies. Apprenticeships can end early only in specific circumstances (mutual agreement, gross misconduct, genuine redundancy, etc.)

📋 Important: Recent Legal Changes (2025–2026)

Minimum wage increase (1 April 2026): The apprentice rate rises from £7.55 to £8.00/hour. Ages 18–20 rise to £10.85; ages 21+ rise to £12.71. Ensure any wage entered reflects the rate applicable at the start date of the apprenticeship.

Minimum duration: From 1 August 2025, the statutory minimum apprenticeship duration reduced from 12 months to 8 months. Most apprenticeships still run 12–48 months depending on level and standard.

Off-the-job training: The previous flat 20% rule has been replaced by a standard-specific minimum hours requirement (floor: 187 hours). Clause 6.1 reflects both approaches. Check the specific hours for the relevant apprenticeship standard at Skills England.

Unfair dismissal (Employment Rights Act 2025): From 1 January 2027, employees will gain protection from unfair dismissal after 6 months' service (reduced from 2 years). If you are setting a probation period, consider keeping it under 6 months so any performance decisions are made before that protection applies. Compensation awards will also be uncapped from that date.

Statutory Sick Pay: The SSP rate is reviewed by HMRC each April. Always check gov.uk/statutory-sick-pay for the current rate before signing.
