🏢 Premises Details

Be specific about the exact area being sublet
? Must not exceed the permitted use in the head lease. The landlord may object if the subtenant's use differs from the original lease.

📅 Term & Duration

? The sublease term CANNOT extend beyond the head lease term. Always allow buffer time before the head lease expires.

Landlord's Consent

? You MUST obtain landlord consent before subletting. Most leases require written consent. Subletting without consent is a breach and can lead to forfeiture.

Service Charge & Utilities

🔧 Repair & Maintenance

? The subtenant's obligations cannot exceed your obligations under the head lease. Typically, subtenant repairs internal areas while structural repairs remain with the head tenant/landlord.
The subtenant's repair obligations should mirror (but not exceed) your obligations under the head lease. Review your head lease carefully before setting repair terms.

📋 Use & Restrictions

? The subtenant's right to make alterations should be more restrictive than your rights under the head lease. Typically, all alterations require consent from both you and the head landlord.

🔄 Yield Up & Dilapidations

? Standard requires subtenant to return premises in good repair and condition, fair wear and tear excepted. Document the initial condition thoroughly.

⚠️ Forfeiture & Break Clauses

? A break clause allows you to terminate early. Essential if the head lease might end early or if circumstances change. Usually requires 3-6 months' notice.
